Watts Guerra Attorney Ryan L. Thompson Moves to Consolidate Byetta Thyroid Cancer Lawsuits

Ryan L. Thompson of Watts Guerra LLP presented oral arguments to the U. S. Judicial Panel on Multi District Litigation (JPML) related to a consolidation motion filed on behalf of his firm’s client, Elizabeth Childress on January 28, 2014. The JPML panel, which consists of seven sitting federal judges, is considering the consolidation of 34 Byetta thyroid cancer lawsuits filed in California and additional actions pending in Arizona and Colorado federal court into Multi District Litigation (MDL).

Thompson, on behalf of Plaintiff Childress, argued that the Panel should consolidate the federal Byetta thyroid cancer litigation in the United States District Court for the Southern District of California under Judge Anthony J. Battaglia. Childress developed thyroid cancer after ingestion of Byetta diabetes medication.

The cases Thompson seeks to coordinate in MDL 2525 share similar evidence and science to certain issues he is already litigating in existing MDL 2452, which is also pending in the Southern District of California before Judge Anthony J. Battglia. MDL 2452, however, includes not only Byetta-related pancreatic cancer cases, but also pancreatic cancer cases related to additional incretin mimetics, including Byetta, Januvia, Janumet, and Victoza, among others.
